Welcome to Cooked & Ate. These Terms of Service govern your use of cookedandate.com and your purchase of products from us. By placing an order through our website, you agree to be bound by these terms.
Who we are:
Cooked & Ate Ltd is a company registered in England and Wales. For any questions about these terms or your order, please contact us using our contact form.
Eligibility
By placing an order, you confirm that you are at least 18 years of age, or that you have a parent's or legal guardian's permission to make the purchase.
Our products
We produce small batches of South Africa-inspired vetkoek baking mixes and recipe spice mixes. We make every effort to ensure that the product descriptions, photographs and nutritional information are accurate. However, colours, packaging and appearance may vary slightly due to photography, printing or batch production.
All products should be prepared, cooked and stored according to the instructions provided on the packaging.
Allergens and food safety
Full ingredient and allergen information is provided on each product page and on the product packaging.
Our products are prepared in a kitchen that also handles allergens, including wheat, milk and eggs. While we take reasonable precautions to minimise cross-contamination, we cannot guarantee that any product is completely free from traces of allergens. If you have a severe allergy or intolerance, please contact us before placing an order.
Orders
Once you have placed an order, you will receive an email to acknowledge receipt. This acknowledgement does not constitute acceptance of your order. A legally binding contract is only formed when we dispatch your order.
We reserve the right to refuse or cancel an order where necessary, including in the event that:
- The product is unavailable.
- An obvious pricing or description error has occurred.
- Payment cannot be authorised.
- We reasonably suspect fraudulent activity.
- If we cancel your order after payment has been taken, you will receive a full refund.
Prices and payment
All prices are shown in Pounds Sterling (£ GBP) and include VAT where applicable. Payment is processed securely through our authorised payment providers. We do not store your full payment card details.
Delivery and returns
Delivery information is set out in our Shipping Policy. Our Return Policy governs returns and refunds. Both policies form part of these terms of service.
Customer responsibilities
You are responsible for ensuring that:
- the delivery address provided is accurate;
- your contact details are up to date;
- products are stored, prepared and used in accordance with the supplied instructions.
Cooked & Ate Ltd cannot accept responsibility for issues arising from incorrect customer-provided information or failure to follow preparation or storage instructions.
Limitation of liability
Nothing in these terms excludes or limits any rights you have under UK consumer law, or any liability that cannot legally be excluded.
Subject to those rights, Cooked & Ate Ltd shall not be liable for losses resulting from the misuse of our products, failure to follow preparation, storage or allergen guidance, or events outside of our reasonable control.
Intellectual property
All content on cookedandate.com, including our brand name, logos, product names, packaging designs, recipes, photographs, graphics, text and other materials, is owned by or licensed to Cooked & Ate Ltd and is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed or used without our prior written permission.
Events outside our control
We are not responsible for any delays or failure to fulfil our obligations resulting from circumstances beyond our reasonable control, including severe weather, industrial action, transport disruption, courier delays, government restrictions, or other unforeseen events.
Governing law
These terms are governed by the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
We may update these terms of service from time to time. Any changes will be published on our website with a revised effective date. The version in force at the time you place your order will apply to that purchase.
Severability
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply in full.
